If Hamilton could see us now…

If Hamilton could see us now…

Alexander Hamilton in Federalist Papers 78

“The courts must declare the sense of the law; and if they should be disposed to exercise will instead of judgment, the consequence would equally be the substitution of their pleasure to that of the legislative body.”

What does that mean?

The role of the courts in our democracy: Interpret laws written by our representatives (the legislative body). Judge laws according to the Constitution.

If judges step over those bounds and make decisions based on raw opinion or personal empathy then we will end up being ruled by the sheer will of unelected persons wearing black robes.
